Construction Litigation
Taft’s construction litigation group is ranked National Tier 1 in Construction Litigation by U.S. News – Best Lawyers® 2020 “Best Law Firms.” Our attorneys execute dispute resolution strategies for our clients that are cost-effective and long-term.
Our experience with construction-related disputes encompasses construction arising from contract negotiations, design and construction defects, change orders, undisclosed site conditions, delay, acceleration and abandonment claims, mechanics liens, property damage and insurance coverage, including defense of title claims.
Our attorneys manage complex construction-related matters in local, state and federal courts, through the American Arbitration Association and in other alternative dispute resolution venues. We are licensed to practice in various state and federal courts, including the Federal District Court of Claims. We have been successful both in the pursuit of multimillion-dollar recoveries and the defense of multimillion-dollar claims. Our experience also includes appeals under the federal Contract Disputes Act (CDA) and the Federal Acquisition Regulation (FAR).
We have vast experience with all types of litigation, including asbestos abatement, bid protests, bond claims, disruption and acceleration claims, delays, construction defects, changes in scope, termination, payment, changes in site conditions, environmental claims, government procurement, tort and product liability, public contracting and design defects. We regularly assist clients with prosecuting claims against their insurance carriers, an important potential source of recovery.
Our client base is extensive, ranging from individuals to multinational corporations, and includes commercial enterprises, nonprofit educational and charitable institutions, utilities, governments and public bodies. We represent many banks and other financial institutions, as well as insurance and surety companies, electric and gas utilities, trade and professional associations and architects and engineers.
Our attorneys have worked with clients on claims arising from projects that include sports stadiums, medical facilities, water plants, luxury apartment buildings, libraries, garages, airport hangars, prisons, schools and office buildings. The claims have ranged from small to tens of millions of dollars.
Our goal is to provide aggressive, yet cost-effective, assistance to help clients maximize their recovery or minimize their loss—always keeping in mind the cost to litigate as compared to the amount at stake.
