Tracy N. Betz

Tracy has extensive first-chair experience in state and federal courts, representing prominent corporations and manufacturers. Her practice includes pre-litigation preparation and advice, obtaining and defending against preliminary injunctions, and all aspects of trial. She also represents clients in construction, product liability, personal injury, criminal defense, and fiduciary and probate litigation matters.

• Obtained a multimillion-dollar verdict for a prime contractor following a two-week jury trial on damages in a complex construction and contract dispute against a subcontractor in Georgia state court. Previously secured summary judgment on liability and successfully defended the judgment on appeal. Also obtained an award of attorneys’ fees.
• Represented a multibillion-dollar agricultural and energy cooperative in a trade secrets and unfair competition dispute against a former high-level employee who used confidential and proprietary business information to launch a competing enterprise. Secured a temporary restraining order and a preliminary injunction, leading to a favorable resolution for the client.
• Prosecuted securities fraud and breach-of-fiduciary-duty claims related to a significant acquisition. After a two-week trial, secured a large judgment against a former executive and collected it in full.
• Obtained emergency injunctive relief against a state after it terminated a concessionaire agreement that effectively shut down the client’s business. Secured a court order restoring the client’s rights to operate and control the property.
• Prevailed in a two-week federal jury trial involving willful trademark infringement claims, obtaining a multimillion-dollar verdict for the client. The court subsequently awarded the client’s attorneys’ fees.
• Obtained a substantial jury verdict for a property owner in a dispute involving extensive property damage, asset conversion, and an improper lien that clouded title to the property. The court subsequently awarded the client’s attorneys’ fees.
• Obtained temporary restraining orders and asset-freeze relief for a coalition of stakeholders, blocking the distribution of corporate assets through dividends and stock repurchases while substantial environmental remediation liabilities and creditor claims remained pending.
• Prevailed on summary judgment for a closely held business and its owners against claims of fraud and breach-of-contract allegedly arising from a stock repurchase transaction. The court also awarded over a million dollars in attorneys’ fees.
• Obtained a preliminary injunction preventing a national insurance company from terminating a nonprofit hospital’s provider agreement, protecting the hospital from potential losses of millions of dollars and a potential shutdown.
• Secured a preliminary injunction for a leading motorsports equipment manufacturer, preventing a national sanctioning organization from decertifying the company’s products and preserving the client’s ability to continue operating.
