Summary
Justin focuses his practice on matters of state and federal taxation. He represents clients on state and local tax (SALT) issues across a wide array of industry sectors, including energy, manufacturing, retail, and logistics. Justin’s SALT practice is concentrated around sales and use tax, commercial activity tax, kilowatt-hour tax, public utility tangible personal property tax, incentives for solar and wind under the Qualified Energy Project tax abatement program, and various other excise taxes.
With respect to federal taxation, Justin frequently advises 501(c)(3), 501(c)(4), 501(c)(6), and 527 entities on federal tax issues related to formation, attaining recognition of exemption, compliance, operational structures, transactions, and dissolution. In doing so, he helps clients navigate the complex supporting organization rules, comply with rules against private inurement and excess benefits, and develop efficient corporate structures for unrelated business activities. His clients include health systems, foundations, standard-setting organizations, advocacy groups, trade associations, and governmental-affiliated entities.
As an outgrowth from both his exempt organizations practice and work within the energy sector, Justin is experienced in planning and structuring energy projects financed through direct pay tax credits available under the Inflation Reduction Act. Projects have included solar facilities, qualified biogas facilities, and combined heat and power system facilities.
Justin earned his J.D. from the Wake Forest University School of Law and his Masters in Taxation from the Georgetown University Law Center. While attending Georgetown, he was an extern with the Honorable Judge Joseph R. Goeke of the United States Tax Court.
