Summary

Brian’s practice includes assessing potential environmental liabilities involved in corporate and real estate transactions and allocating associated risks. In the real estate context, Brian assists clients in analyzing the costs and benefits of leveraging state Brownfield or Voluntary Cleanup Programs to address environmental impacts, navigating the completion of those programs, and, when available, recouping eligible costs through tax credits or other financial incentives.

Brian also helps businesses ensure regulatory compliance with hazardous waste laws and, when necessary, defend against state or federal enforcement actions or investigation requests. Brian aims to help his clients understand the practical implications of environmental issues and develop business-facing solutions.

Brian attended the University of North Carolina and later attended Stetson University College of Law, where he served as Executive Editor of the Stetson Law Review. While attending Stetson, Brian competed in the National Environmental Law Moot Court Competition, served as treasurer for the Environmental Law Society, and worked as a fellow for Stetson’s Institute for Biodiversity Law and Policy. Before enrolling in Stetson and embarking on his legal career, Brian managed multiple fundraising offices for an environmentally focused non-profit organization.

  • Represented Georgia landowner in responding to call-in letter and investigation requests from the Georgia Environmental Protection Division under the Hazardous Site Response Act (HSRA) and successfully obtaining determination that property did not warrant listing on the state’s Hazardous Site Inventory.
  • Conducted environmental due diligence for multiple nationwide, publicly traded real estate investment trusts (REITs) in connection with mergers and portfolio acquisitions.
  • Represented a nationwide retailer in responding to information requests issued by the federal Environmental Protection Agency (EPA) under the Resource Conservation and Recovery Act (RCRA) and negotiating associated settlement.
  • Represented an institutional investor in responding to information request issued by EPA under the federal Superfund law (CERCLA) relating to divested property.
