Summary
Alan currently serves as Taft’s Florida chairman and partner-in-charge of the West Palm Beach Office. He concentrates his practice on the litigation of business disputes at the trial and appellate court levels.
He helps clients navigate complex civil and commercial litigation, including contract and business disputes; real estate matters; partnership and corporation disputes, including shareholders’ derivative actions; class actions; securities litigation; bankruptcy and creditors’ rights; probate litigation; and matters involving lawyers and law firms, including legal malpractice claims.
Alan is double board-certified by the Florida Bar Board of Legal Specialization and Education in Business Litigation Law (2004 to present) and Appellate Practice (2015 to present).
He was the managing shareholder and one of the founding shareholders of Mrachek, Fitzgerald, Rose, Konopka, Thomas & Weiss, P.A., which merged into Taft in 2025 after 25 years as a litigation boutique.

Notable Matters
- Represented public company, which was the acquirer in merger transaction, in an arbitration against the seller/former CEO, and in related state court proceedings to confirm award.
- Represented on appeal buyer of a $34 million residence, to successfully defend a jury’s $7 million verdict finding the seller had actual knowledge of material hidden defects, and currently pursuing claim of fraudulent transfer against seller’s owners.
- Represented restaurant and catering tenant in wrongful eviction jury trial against landlord and management company, resulting in $10.8 million verdict for client.
- Represented defrauded real estate seller in bankruptcy and appellate courts in action against accounting firm and its insurer, resulting in affirmance of a $3.2 million judgment.
- Handled securities arbitration for investor in a Madoff feeder fund against major brokerage firm which recommended the investment. The case was settled on confidential terms.
- Worked as appellate counsel on legal team defending regional savings bank in a federal court class action under the Driver Privacy Protection Act, in the Eleventh Circuit and in a Petition for Certiorari to the United States Supreme Court.
- Represented several AmLaw 100 law firms and other law firms in defending legal malpractice claims against those firms, including a five-week jury trial in which damages were sought in excess of $13 million.
- Represented a hospital district located in Volusia County, Florida, to pursue its claim for legal malpractice against a regional Central Florida law firm.
- Represented a beneficiary of an estate in litigation against the attorneys who drafted a will, on grounds that they failed to draft documents and advise client’s father properly. The case was resolved confidentially.
- Obtained reversal on appeal of jury verdict and a new trial for real estate development company in litigation brought by a former employee-shareholder.
- Defended a national trust company in an action for fraud and breach of contract in an alleged sale of stock, including at trial in federal district court in Indianapolis; on appeal twice to the U.S. Seventh Circuit; and in defending against Petitions for Certiorari to the U.S. Supreme Court.
- Represented the owner of an offshore gambling vessel in a lawsuit brought against it by the Florida Attorney General for offshore gaming activities and RICO violations. After an eight-day jury trial in Florida state court, the jury entered an award in favor of our client.
- Represented a retired law firm partner seeking to recover substantial retirement benefits, which withdrawing partners refused to pay. After a four-day arbitration proceeding, the arbitrator ruled in favor of the firm’s client.
- Represented former employee in litigation over a trade secret and restrictive covenant matter, which was arbitrated, and which resulted in an award in favor of client.
