Summary

Aaron is a seasoned trial attorney, with extensive experience in all stages of litigation in Federal court, including Markman hearings, depositions, pretrial investigation, discovery, pre- and post-trial motions, appellate work, and most importantly, trial. Aaron also has extensive experience in commercial litigation and arbitration proceedings.

Aaron focuses his practice on intellectual property matters with an emphasis on patent infringement litigation and other matters concerning technology. He represents clients across a broad spectrum of technological areas, including pharmaceuticals, the chemical industry, medical devices, data processing systems, computer software and hardware, computer chip technology, construction materials, safety and security technologies, control technology, business methods, pet care products, and telecommunications.

His chemical and pharmaceutical background provides him with real-world industrial perspective when working with clients, and particularly those involved in the generic drug industry and Hatch-Waxman/ANDA litigation. Aaron also enjoys managing the acquisition, enforcement, and protection of intellectual property rights, including patents, trademarks, trade secrets and copyrights. He has counseled clients on a variety of IP matters, including licensing, due diligence, FDA regulation, and portfolio strategy. He is registered to practice before the USPTO and has experience in patent prosecution and opinion work.

Prior to his legal career, Aaron’s professional interests concentrated on the synthesis and characterization of complex natural products and related analogs with pharmaceutical activity, in both academic and industrial settings. While attending law school, he clerked with the IP department of a Fortune 500 corporation’s pharmaceutical division. Aaron served as a judicial law clerk for the The Honorable Raymond L. Erickson, United States District Court for the District of Minnesota.

  • Represented many generic pharmaceutical companies in complex Hatch-Waxman cases that achieved the clients’ business objectives after hard-fought and contentious litigation, up to and including trial.  These cases included patent claims directed to:

  • Represented generic pharmaceutical company defending against claims for patent infringement. Successfully argued the claim construction (Markman) hearing. The litigation settled shortly after the court issued its claim construction.
  • Obtained summary judgment of non-infringement in construction materials case that was upheld on appeal by the Court of Appeals for the Federal Circuit.
  • Obtained partial summary judgment for patent owner in dispute over Alice patent eligibility regarding patents directed to software and data processing systems.
  • Represented patent owner in pursuing patent infringement claims against alleged infringer related to chip programming technology. After fact discovery, Markman claim construction ruling, and expert discovery, the litigation was resolved on mutually agreeable terms.
