Get Your Wage-Hour Exemptions in Order

Audits and litigation over misclassified positions under the Fair Labor Standards Act pose a serious threat to unwary employers. We will review the elusive “white collar” exemptions to the minimum wage and overtime requirements of the FLSA, with a particular focus on the frequently misapplied “administrative” exemption. Correctly classify your salaried workforce to satisfy the Department of Labor and to fend off collective actions in court.

The Trump Administration has issued Executive Orders impacting both Affirmative Action  (“AA”) plans and Diversity, Equity and Inclusion (“DEI”) programs in the workplace. While being challenged in the courts, these Orders have the potential to impact both private and public sector employers in many ways. We will discuss where things stand on the legality of such plans/programs and what steps employers should take to address the risk of litigation over their usage.
