Taft Appellate Group Wins Reversal of $45 Million Verdict
Taft partners J. Timothy Eaton and Jonathan B. Amarilio, along with associates Ioana M. Guset and Allison E. Czerniak, successfully argued for the reversal of a $45 million verdict against Taft client Oldcastle AGP South, Inc. d/b/a Northfield Block Company (Northfield Block). The case concerned an oil spill in Romeoville, Illinois, which plaintiff Enbridge Energy, Ltd. Partnership (Enbridge) said was the result of Northfield Block’s failure to maintain a water service line on its property. The jury returned a verdict for Enbridge on its breach of contract and negligence claims, but Eaton and the Taft appellate team convinced the appellate court not only to reverse the verdict for lack of evidence, but also to enter judgment for Northfield Block on all of Enbridge’s claims, ending the case in favor of Taft’s client.
