I Heart Mac & Cheese Franchisor Sanctioned After Taft Helps Secure Franchise Fraud Victory
The Indiana Securities Commissioner has issued a final order against Mac and Cheese Franchise Operations, LLC, franchisor of I Heart Mac and Cheese, finding multiple violations of the Indiana Franchise Act tied to allegedly misleading and materially deficient franchise disclosure documents provided to Indiana investors.
Taft represented franchisees Matt and Elizabeth Griffin in filing the initial compliant that ultimately led to this order. The order concludes that the company failed to disclose significant litigation, related restaurant entities, and key executive affiliations, and that these omissions — combined with franchise sales practices —amounted to franchise fraud under Indiana law. The order imposed cease-and-desist relief, rescission, disgorgement, and civil penalties.
