U.S. District Court Chief Judge John Tunheim granted the University of St. Thomas’s motion for summary judgement against an anonymous plaintiff who had alleged that the University was negligent in its investigation and adjudication under its Sexual Misconduct Policy of an allegation of sexual assault made against him. While Judge Tunheim had previously dismissed all other claims asserted by the plaintiff, the plaintiff’s sole remaining claim alleged that the University had breached its duty of care with regard to the plaintiff.

According to the court order, “Although the Court finds that UST owed John Doe a duty of reasonable care, even considering all of the facts in a light most favorable to Doe, Doe cannot show a genuine issue of material fact as to UST’s alleged breach. The Court therefore concludes that no reasonable jury could decide that UST breached its duty of care.”
