Emory Moderates ABA Webinar on Third-Party Litigation Funding
On Nov. 5, 2025, Senior Associate Jena Emory served as moderator for an American Bar Association webinar titled “Third-Party Litigation Funding: Dancing Through the Raindrops or Taking Fortune at the Flood.”
The program explored the ethical and practical considerations of engaging with outside litigation funders—a rapidly growing area in the legal landscape. Panelists discussed best practices for protecting attorneys and clients, avoiding ethical pitfalls, and navigating evolving case law. Materials covered included Model Rules of Professional Conduct 5.4(a) and (c); 1.8(a) and (e); the ABA Best Practices for Third-Party Litigation Funding (2020); and recent New York City Bar opinions and recommendations concerning non-party litigation funding.
