The article discusses the U.S. Court of Appeals for the Federal Circuit’s decision in Royal Brush Manufacturing Inc. v. U.S. that overturned a CBP determination on the ground that in the agency proceedings, the regulated entity had not been furnished with the pertinent information on which the agency’s adverse determination had relied.
