Taft Secures Important Land Use Win for Municipal Client
On Feb. 22, Taft won an appeal preserving an important land use decision reached by the City of Seymour’s board of zoning appeals. BP2 Construction, LLC sought to operate a business that recycles concrete and asphalt fill next to a residential neighborhood. Citing a series of problems caused by situating that industrial use next to a residential neighborhood, the board of zoning appeals denied BP2’s variance application. In a decision tracking the arguments advanced by the board of zoning appeals, the Indiana Court of Appeals upheld the variance denial.
Taft lawyers Chou-il Lee and Beth Copeland represented the board in the trial court. Donnie Morgan led the appeal.
