Clayson Presents at National Association of Bankruptcy Trustees Annual Meeting
Taft Detroit attorney Kimberly Ross Clayson recently presented on Subchapter V Trustee Standing: Can We Do That? at the National Association of Bankruptcy Trustees Annual Meeting in Scottsdale, Arizona in June 2025. The panel discussed the statutory powers and authority of trustees appointed under Chapter 11, Subchapter V of the Bankruptcy Code, whether Subchapter V trustees have powers that extend beyond the text of the Bankruptcy Code and discussed the question of Subchapter V trustee standing to pursue causes of action for a Debtor’s estate such as preference claims and other avoidance actions.
Clayson is an attorney in Taft’s Bankruptcy and Restructuring practice group. She serves a diverse client portfolio in the areas of insolvency law, creditors’ rights, business law and health law. She provides counsel to operating businesses and financially distressed businesses and individuals. Clayson has extensive experience representing secured and unsecured creditors in bankruptcy proceedings, restructuring business debtors, conducting fraud investigations for bankruptcy estates, and bankruptcy litigation. She was appointed and presently serves as one of five Subchapter V Trustees in the Eastern District of Michigan under the Small business Reorganization Act of 2019.
