Drafting and Prosecuting for Software Patent Eligibility: A Section 101 Playbook for 2026 [Taft IP Webinar Series]

This program will equip patent prosecutors with concrete strategies for turning close Section 101 calls into patent‑eligible wins in light of the USPTO’s latest subject matter eligibility guidance. Taft IP attorneys Robin Dunn and Patrick Palascak will unpack the newest memoranda, MPEP revisions, and AI/software-focused updates, explaining how to best frame Step 2A and Step 2B analyses. Using hypotheticals and real-world examples, the program will show how to draft applications in anticipation of subject matter eligibility challenges and how to leverage technological improvement arguments, practical application rationales, and Subject Matter Eligibility Declarations (SMEDs) to overcome rejections.
