Program Description:
Potential data breaches and cyber-attacks are an unfortunate reality. Law firms are a targeted section of the economy for ransomware/ extortion, social-engineering, wire transfer fraud, and other attacks. Bad actors’ use of generative AI has increased the frequency and success of these attacks. Law firms must be concerned with unauthorized access to their own information, as well as focused on the protection of client data and information belonging to third parties. What are the sources of lawyers’ duty to protect client data? What are the best practices for maintaining data security compliance, fulfilling lawyers’ ethical obligations, satisfying client demands, and avoiding loss? This program addresses lawyers’ duty of technological competence in representing clients and steps that everyone at law firms should take to safeguard against cyber risks. Model Rules of Professional Conduct, Rules 1.1, 1.4, 1.6, 1.15, 4.4, 5.1, and 5.3.
