Cyrus Malek is an attorney and member of the Business Litigation section and the Privacy, Data, and Cybersecurity group. In his practice, Cyrus primarily represents clients in business disputes, complex civil appeals, and data-privacy matters. Cyrus also has experience in energy transactions and regulatory compliance.
Cyrus represents individual and corporate clients in a variety of business disputes. His experience includes antitrust, banking, bankruptcy, commercial contract, commercial leasing, construction defect, data practices, defamation, employment, estate and trust, medical malpractice, personal injury, privacy, public utilities, technology, toxic tort, and trademark infringement matters.
Cyrus has extensive appellate experience and has litigated appeals involving a variety of issues, including construction contracts, commercial leases, personal injuries, the Minnesota Government Data Practices Act, public-utility requests for proposal, and securities registration. He has practiced before the California Court of Appeal (First District祐an Francisco), Minnesota Court of Appeals, Minnesota Supreme Court, North Dakota Supreme Court, and the United States Court of Appeals for the Eighth Circuit. He is admitted to practice in Minnesota (both state and federal courts), in the United States Court of Appeals for the Eighth Circuit, and in the United States Court of Appeals for the Federal Circuit.
Privacy, Data Security and Cybersecurity
Cyrus offers a broad range of services to help clients prevent, prepare for, and minimize the impact of security breaches and cyber attacks. His experience includes counseling clients regarding multi-state data breach response and remediation; drafting terms-of-use policies and privacy notices; evaluating cyberinsurance policies; negotiating and drafting contracts for compliance with privacy objectives; and litigating data-loss issues. In 2016, Cyrus obtained his certification in Cybersecurity and Privacy Law from Mitchell-Hamline School of Law.
Cyrus has experience in energy law, including electricity sale and purchase transactions, public utility rate proceedings and regulatory compliance.
After law school, Cyrus served as a judicial clerk to Judge Terri J. Stoneburner and Judge Peter M. Reyes at the Minnesota Court of Appeals.
In law school, Cyrus was a member of Law Review, externed for the Honorable Patrick J. Schiltz of the United States District Court for the District of Minnesota, competed in the Vale Corporate Moot Court and was selected as a Marshall-Brennan Fellow.
Prior to law school, Cyrus was a sportswriter for the online soccer publication Goal.com.
