Taft Chicago partner Rachel Schaller authored the article, “Pregnancy Bias Ruling May Offer Road Map For ADA Cases,” which was published in Law360 on Aug. 23. The article provides further analysis and insight on the ruling in U.S. Equal Employment Opportunity Commission v. Wal-Mart Stores East LP, to reject the EEOC claim of pregnancy discrimination present in Walmart’s temporary light duty program.
While this ruling is specific to pregnancy discrimination, Schaller explains how the court’s analysis could give weight to future arguments in defending limited light duty programs against other claims of disability discrimination under the Americans with Disabilities Act.
