« Back July 1 Deadline for 2008 Toxic Release Inventory (TRI) Reports

June 16, 2009

Annual Toxic Release Inventory Reports must be submitted by July 1, 2009.  This year, EPA made several changes to the reporting requirements which may subject some companies to reporting for the first time.  Other companies that have been filing annual TRI reports may find they need to report for additional chemicals.

TRI reporting is usually accomplished by filing Form R, which provides detailed information of chemical releases and disposal for the prior calendar year.  In some cases, EPA allows a much simpler reporting from, Form A, to be filed.  This year, the circumstances in which the simpler Form A may be filed have been substantially narrowed (see www.epa.gov/tri/).

EPA has stepped up monitoring of companies potentially subject to TRI reporting, including businesses that believed themselves to be exempt.  Since non-compliance penalties can be severe, any company using hazardous or toxic chemicals should review their TRI reporting obligations.

If you have questions or need further information about TRI and Form R reporting, call Larry Vanore at 317-713-3524, or any member of Taft’s Environmental Practice Group.
