The Obama administration's promised "Card Check" legislation is one of the most far-reaching employment laws ever proposed. It permits unionization by "card check," a notoriously unreliable indicator of union support, and provides unprecedented opportunities for union intimidation and mischief.
After achieving a card check "majority," the proposed legislation requires mandatory arbitration over contract terms within 120 days, if the parties fail to reach their own agreement. This means that unions will not have to negotiate in good faith, because arbitrators will be empowered to set the terms and conditions of employment over the employer's objection.
Unionization in America has been in decline for 30 years because it no longer serves the larger public interest. Subjecting the entire U.S. economy to this outdated system poses a real threat to every employer and the economy as a whole. Labor attorneys from Taft Stettinius & Hollister will address the provisions of the proposed "Card Check" legislation in detail, and provide preliminary strategies for compliance, employee education, and protecting employees' right to choose. The U.S. Chamber of Commerce and the Dayton Area Chamber of Commerce leadership will describe the business community's efforts to educate lawmakers on the impact of the proposed legislation, and what employers can do to assist in the effort to defeat it.
